I think it's great, and yes more states should adopt it. Nothing sicker than putting anyone's private stuff out there, no matter how bitter the break-up was.
And not just revenge porn. Any situation where someone is filmed seemingly in confidence and said film is put out for all the public to see. If all parties don't consent to it, then it shouldn't be out there. And if it does come out somehow, there should be consequences...and not just the consequences the victims suffer.

OK. What about the person who didn't screw around on his or her partner? Some relationships just fall apart on their own and you don't get the chance to ask for your stuff back. Maybe it was the poster of the video that moved on, moved in with a new partner, then later decided to post the videos of the former lover. That would be an innocent victim. And those should be protected.

Wrong! They trusted someone who then betrayed them. The person who posts the pictures lacks all common decency, has no redeeming value, and is a lousy scumbag traitor of the lowest moral character. They should get a stiff prison sentence and hopefully catch a lot of stiff ones up the ass while enjoying their incarceration.
Any real man would never post pictures of an ex-girlfriend, fiancée, or wife of that nature for public viewing. A person who does that is a very small minded selfish person, about as mature as a toddler.
I hope that the legislatures of all 50 states pass a strict law and require severe sentencing to cover this matter.

It's awfully dismissive of you to say the things you said. To compare the poor decision of a soldier to some poor schmuck having private photos or videos uploaded to a website is like comparing apples and oranges. What it does not do, is address the effect that having a revenge video/photo, whatever could have on an individual - Sometimes, we trust people - we have to (you must know that as well as anyone else). Sometimes, they betray that trust - it happens in all levels of life.
You rightly point out that this is a sex site. As such, the topic of the thread is completely relevant - many of us here will have shared such personal images and whatnot, so it's a subject that may be close to the hearts of many.
To pull the "people DIE" card is quite frankly off topic, disrespectful and irrelevant. I would have hoped that a career in the military would have taught you a little more respect than that.

As for the penalties, I would need to see the full tariff compared with other forms of sexual assault - but I would have thought the high end should be considered equivalent to .

I'm not too sure how I feel about this. I feel some responsibility lies with the person being filmed. If you never want to go "viral" then don't be filmed, at least not with your face in view.

I don't understand this line of reasoning at all. I understand that actions have consequences, that is precisely why there should be jail time for people who post things on the internet of their ex's for revenge. Making a video or sending naked pictures isn't a great idea but if you are a consenting to sending a naked picture you are not consenting to have it uploaded to a site as a result of some argument. Does sending a picture mean that the person has a right to post it all over? Definitely not.
Also comparing illegally uploading pornographic pictures and war is childish and pointless.

I know you didn't care for my advice last time, but I feel compelled to try once more. Disagreeing with you and being male doesn't make them "Internet tough guys." Doing so while being female doesn't make them "weepy." We're not here to argue or embarrass each other; we're a fun group really. Do you have to rely on insults and lectures to get by on other sites? I don't think this law should pass. Sharing an ex lover's pics is a shitty thing to do, but it shouldn't be a criminal offense. Legislating morality doesn't work.
If Person A takes pics of his junk and gives it to Person B, then it becomes property of Person B and Person B can do with it whatever he wants. (assuming everyone involved is not a minor) Does it makes Person B a shitty douchebag of a person? Fucking right it does. Person A, the victim, does have some remedy. He can sue Person B in civil court for damages, emotional distress, and presumably breach of verbal contract to NOT share pics.
This law would be way too easy to abuse. In this day and age of smartphone, a person could have pics of a lover's boobs from a text on his phone. Phone is stolen, or even a friend could borrow the phone, whatever.. see the pics and post them somewhere. No way to prove who did or didn't post the pics. A scorned lover could easily post naked pics (exact copies of what's been willingly sent to an ex) of him/herself on a website under the ex's name.
This is just the new technological age of a scorned lover telling everyone that their Ex has a little dick. Or that his Ex is a whore and has a loose pussy. Or posting personal, intimate, couple-related information on facebook about an ex, that can be just as bad. Humiliating an ex in some lame attempt to make himself feel better. Shitty.. yes. It's a great idea in concept but it will be a major drain on the courts and legal system and public defenders because it's just so prolific a practice... all those myex.com sites and blunders... it's endless. Jails are already jammed in many places, I really don't know if they have the resources to start tossing in the evil exes. Don't a lot of people and celebs get jail-time massively reduced because the jails are at max capacity? I'm sure I remember Lohan and Paris serving only a day to a week and then being released because there was no jail-space for small-time offenders. A lot of cases will be difficult to prove as well because there are so many variables that come into play. I think they should go after those that post pics of minors etc and then consider hefty fines for other cases or small-claims court if the victim wants to go after the person that posted the pics. I'm not sure jail-time is feasible given the demands on the justice system in a lot of areas.

Often in cases like these jail time is unnecessary - the conviction alone should be enough to damage reputation and discourage the offence. I don't know how they're making this law stick in California but the process in the UK is being set up to go through the indecency laws - making it criminal rather than the civil proceedings people have been limited to so far.
Any conviction will give a criminal record to the perpetrator as well add his (I don't think i'm being too sexist here) name to the sexual offenders register. Both of which will come up if he ever goes for a job that requires a CRB check.

If you created something - even if it's just a picture of your meat and two veg - you have copyright of that image and you're able to enforce that image's usage (according to copyright law). You don't have to put the little (c) sign on it, you don't have to include terms and conditions. If you created it - you own it.

Post a pic of an ex online is more of a revenge motivated attack than a sexually motivated one, to me. The tool of the attack may be sexual in nature but doesn't necessarily qualify as sexually motivated. I understand your point and I respect your opinion, I just disagree this time.
